Why Hamptons Charters Carry Six Passengers: The USCG Rule Explained

You found the perfect boat, started a group text, and got eleven yeses. Then the charter company said six passengers, max. It feels arbitrary. It is not. It is federal law, and once you understand it, it changes how you plan a boat day out here.

The rule in plain English

The US Coast Guard sorts passenger boats into two groups. Inspected vessels go through formal USCG inspection and can carry bigger groups. Uninspected vessels do not. For boats under 100 gross tons, which covers nearly every charter boat out here, the cap is six paying passengers.

Most private charter boats in the Hamptons, including ours, run as uninspected vessels. That is why you see the same six-passenger limit across nearly every local operator. Captains even call the standard license the six-pack.

A 40-foot boat with six people? Yes.

This is the part that surprises groups. The limit is not about space. It is about how the vessel is certified. A large boat with plenty of seating still carries six passengers if it is uninspected. No captain can waive it, and any operator who offers to squeeze in extra guests is telling you something important about how they treat the rest of the rules.

Why the rule exists

Inspected vessels carry extra requirements built for crowds. The six-passenger cap draws a clean line: small private groups on this side, commercial crowd operations on that side. It keeps captained day charters simple, personal, and safe.

How to plan a group bigger than six

You have real options, and the earlier you plan, the better they work.

Count heads before you book. Six passengers means six guests. The captain does not count against your number.

Split into two boats. Larger parties often book side by side trips that cruise together and raft up at the sandbar. Same party, two hulls. Ask about pairing trips when you call.

Why six is secretly the best number

Here is the honest upside. Six people on a private boat is a great day. Everyone gets a seat with a view. Nobody waits for the ladder after a swim stop. The captain learns names, not headcounts. The big party boats trade all of that for volume.
